ACCEPTANCE OF THE TERMS

These terms and conditions are entered into by and between You and Guin AC & Plumbing Service ("Company," "we," or "us"). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, "Terms"), govern your access to and use of www.guinservice.com, including any content, functionality, and services offered on or through  guinservice.com  (the "Website"), whether as a guest or a registered user. Please read the Terms carefully before you start to use the Website. By using the Website or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, found at https://www.guinservice.com/privacy/, incorporated herein by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Website.  This Website is offered and available to users who are 18 years of age or older. By using this Website, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

CHANGES TO THE TERMS

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter. However, any changes to the dispute resolution provisions set out in Governing Law and Arbitration will not apply to any disputes for which the parties have actual notice on or before the date the change is posted on the Website.  Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you. 

ACCESSING THE WEBSITE AND ACCOUNT SECURITY

We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users, including registered users. You are responsible for both:

You also agree to ensure that you exit from your account at the end of each session. We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms.

Limited License.

Subject to and in accordance with these Terms and other guidelines or instructions we include in the Digital Product, we grant you a limited, non-transferable, non-sublicensable, non-exclusive, revocable license ("License") to make individual use of the Digital Product, including any courses purchased by you. Your purchase of any Digital Product only entitles you to view that Digital Product in accordance with the foregoing License, and is not a purchase of the software or content constituting or included in the Digital Product. More specifically, unless explicitly authorized in these Terms or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Digital Product(s). You may, however, from time to time, download and/or print one copy of the individual pages of the Digital Product for your individual use, provided that you keep intact all copyright and other proprietary notices. The License is for individual use. You may not assign or transfer any of your rights or obligations under this Section or these Terms to any person or entity and any attempt to do so is void. We reserve the right to terminate your access to the Digital Product at any time if we find that you have violated these Terms. We will make every attempt to notify you of any violation of these Terms and give you an opportunity to remedy the violation. However, if you fail to remedy the violation or continue to Violate the Terms, we will terminate your access to the Digital Product with no refund of fees.  

RECURRING PAYMENTS.

If you have signed up for a payment plan, you hereby authorize our continued access to your financial information stored by our third party financial processing company referenced in this Agreement until your payment plan is complete, as set forth in your acceptance of the purchase terms upon checkout.

LATE PAYMENTS.

If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Chargebacks.

You agree to make every attempt to request a refund prior to attempting a chargeback with your financial institution. In the event of a chargeback attempt, you expressly agree to forfeit any and all of our bonuses, affiliate bonuses or other materials afforded to you in exchange for your original purchase of our Digital Product. We reserve the right to present proof of your access and these Terms to the financial institution investigating the dispute.

Media Release.

You agree that the Company may use any images, audio recordings or video recordings of you obtained while enrolled in a program or any other service provided by us. You waive any right to payment, royalties, or any other consideration for the use of such images, audio recordings or video recordings. You waive the right to inspect or approve the finished product, including written or electronic copy, wherein your likeness appears. The Company is hereby held harmless and released and forever discharged from all claims, demands, and causes of action which you, your heirs, representatives, or assigns have or may have by reason of or related to this authorization.

Digital Product Termination.

You have the unilateral right to terminate your use and access to any of our Digital Product(s). Please send an email to info@guinservice.com  to initiate this process. Termination will not excuse you of further payment. Upon confirmation of your termination, any and all outstanding balances will become immediately due and payable. Any existing balance that remains after 30 days from the date of termination will be sent to a collections agency, and you agree to be responsible for any additional charges, fees or costs associated with such a collection effort, including but not limited to reasonable attorney's fees and court costs.

RATINGS, REVIEWS & TESTIMONIALS

The Website and other third-party platforms including social media accounts may allow you to post reviews, ratings, and comments about our products (collectively, "Reviews"), and you are solely responsible for any content, opinion, statement, recommendation, or advance contained therein. Reviews posted on our Website or on any third-party platform are your Content or the Content of other users, and such Content is not endorsed by us nor does such Content represent the views of the Company. You acknowledge that any Reviews are the opinions and views of their respective authors who are solely responsible and liable for their content. We have the right, but not the obligation, to monitor or review any Reviews at any time. We reserve the right to refuse to post or remove any material submitted or posted in any Review. Because we expect users to maintain a high level of integrity with respect to rating and reviews posted on our Website or related to our products or services, you agree: (i) to base any Review solely on your first-hand experience; (ii) you will not provide any Review if you have an employment relationship or other affiliation with us; (iii) you will not submit a Review in exchange for payment or other benefits from any individual or entity; and (iv) your review will comply with these Terms. You may be able to submit photographs in connection with Reviews ("Photographs"). By submitting Photographs, you grant us and our agents a worldwide, perpetual (even after termination of these Terms) irrevocable, royalty-free, non-exclusive and sub-licensable right to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit the Photographs, to display your name and likeness in connection therewith, and to incorporate the Photographs in other works in any and all markets and media, whether now known or hereinafter discovered, without any additional approval or consideration, in connection with advertising and marketing our products and services and to otherwise provide or improve the products and services. Photographs submitted by you must not violate any applicable laws, rules, and regulations. We shall have no obligation to copy, publish, display, or otherwise use or exploit Reviews or Photographs

INTELLECTUAL PROPERTY RIGHTS

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms permit you to use the Website for your personal, non-commercial use only. The Company name  Guin AC & Plumbing Service, the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to use the Website:

• In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
